This policy explains how Headway Jersey collects, uses, and protects your contact information when you sign up to receive communications from us by SMS or email using Mailchimp Email Marketing and SMS Platform.
Who we are
Headway Jersey is a registered charity based in Jersey, Channel Islands. We are the island's only specialist brain injury day centre. We are committed to protecting your personal information in line with the Data Protection (Jersey) Law 2018, which provides equivalent protection to the EU General Data Protection Regulation (GDPR).

What information we collect:
When you sign up to receive communications from us, we collect your name, email address, and/or mobile phone number. We may also collect information about how you interact with our messages, such as whether you opened an email or clicked a link. This helps us understand what is useful to you.
Why we collect it and our legal basis:
We rely on your freely given consent as the legal basis for sending you marketing communications. You will always be asked to opt in before we contact you by email or SMS. We will never assume consent from silence, inaction, or pre-ticked boxes.
We use your information to send you updates about our work, fundraising campaigns, events, news from the brain injury community, and ways to support Headway Jersey. We will only contact you for the purposes you agreed to when you signed up.
How we use SMS messaging:
If you have opted in to receive SMS messages from Headway Jersey, you agree to the following terms.
Message frequency will vary. We aim to keep SMS contact reasonable and relevant. Standard message and data rates from your mobile network operator may apply. You can opt out at any time by replying STOP to any message we send. After opting out, you will receive one final confirmation message and no further SMS contact.
We do not use automated SMS systems for marketing without your prior consent. We will never send unsolicited commercial messages.
How we use email:
If you have opted in to receive emails from Headway Jersey, we will contact you with updates, campaigns, events, and fundraising news. Every email we send includes a clear and easy unsubscribe link at the bottom. Clicking that link will remove you from our mailing list within 10 working days.
Your rights under the Data Protection (Jersey) Law 2018
You have the right to access the personal data we hold about you, to correct inaccurate data, to request erasure of your data, to withdraw your consent at any time without affecting the lawfulness of any processing before withdrawal, to object to processing, and to make a complaint to the Jersey Office of the Information Commissioner (JOIC).

How long we keep your data:
We keep your contact information for as long as you remain opted in to our communications. If you unsubscribe or withdraw consent, we will delete or anonymise your data within 30 days, unless we are legally required to retain it for another purpose.
How we protect your data:
We take reasonable technical and organisational steps to protect your personal data from unauthorised access, loss, or misuse. We do not sell, rent, or trade your personal information to third parties. We may share data with trusted third-party service providers (such as our email or SMS platform) who process data on our behalf under a written agreement that meets the requirements of the Data Protection (Jersey) Law 2018.
Transfers outside Jersey:
Where we use third-party platforms that process data outside of Jersey, we ensure those transfers meet the requirements of the Data Protection (Jersey) Law 2018, including that the receiving country or organisation provides adequate protection.
Changes to this policy:
We may update this policy from time to time. Any changes will be posted on this page with an updated date. Continued use of our communications after any change constitutes acceptance of the updated policy.
