Why leave a gift to Headway Jersey?

How to Leave a Gift in Your Will?

1. Choose who you want to include

Your loved ones come first. After you’ve taken care of them, even a small percentage of what’s left can have a huge impact for our members.

2. Decide on the type of gift

There are three main ways you can leave a legacy gift:

  • Residuary gift – a share of what’s left after other gifts and expenses

  • Pecuniary gift – a specific amount of money

  • Specific gift – such as property, investments, or valuable items

3. Consider inheritance tax

In Jersey, gifts to registered charities in a will may provide tax benefits, particularly an income tax exemption on the charity's income and potential income tax relief for the donor. While Jersey does not have an inheritance or gift tax, specific rules apply to charitable bequests and it is essential to consult with a legal advisor to ensure proper drafting and compliance. 

4. Update or create your Will

  • Not necessarily. Many local firms offer Will-writing services at reasonable prices, and we may occasionally offer free Will schemes. Speak to your solicitor for guidance.

  • While you are legally permitted to write your own will in Jersey, it is strongly not advisable to use DIY or online will kits due to the specific and strict requirements of Jersey law. Homemade wills run a high risk of being invalid or failing to cover all assets correctly, which can lead to significant problems and expense for your beneficiaries after your death. 

    • Separate Wills for Property: Jersey law distinguishes between movable estate (money, possessions, shares) and immovable estate (land, houses, long leases). It is common and recommended practice to have separate wills for each.

    • Formal Witnessing Requirements: There are specific rules for witnessing wills in Jersey:

      • Both types of wills must be signed or acknowledged by you in the presence of two witnesses present at the same time.

      • For a will of immovable property (realty) made in Jersey, one of the witnesses must be a Jersey Advocate, Solicitor of the Royal Court, or a member of the States. The will must also be read aloud in the presence of you and the witnesses.

  • Absolutely. Your Will is yours to change at any time. If your circumstances or intentions change, your solicitor can help you update it.

  • Even a small gift can make a big difference. Every pound helps fund essential services for brain injury survivors in Jersey.

  • You can let us know if there’s a particular area of our work you'd like to support. While unrestricted gifts give us the flexibility to use funds where they’re most needed, we’ll always honour your wishes where possible.

  • You can add Headway Jersey with a simple amendment called a codicil. Your solicitor can advise you on how to do this easily.
